One of the many ways the employer and insurer may try to deny you claim is on the basis that you are “faking” your symptoms. In order to determine if you are faking, they will typically have you undergo an Adverse Medical Examination to assess your symptoms. Mike Bryant posted about “Waddel signs” which is a series of tests that the adverse examiner may use to determine if you are faking.

As Mr. Bryant noted in his blog, if an adverse examiner believes you have certain “Waddel signs” there are ways in which an experienced attorney can attack those findings.

If you find yourself in a situation where you are without council and the adverse examiner is against you, it may be in your best interests to retain an experienced and knowledgeable attorney to help you.

Attorneys rely heavily on case law to support their case or to dispute the other sides position. Several services such as Westlaw and Lexis-Nexis offers the ability to search for particular cases related to work comp matters. Unfortunately, these services can be quite expensive.

Fortunately, there are less expensive alternatives for researching case law. The Workers’ Compensation Court of Appeals (WCCA) website offers individuals the ability to search cases through 1995.

The WCCA is in the process of adding cases through 1984. For decisions not currently in the case archive see the Workers’ Compensation Decisions (W.C.D.) volumes published by the Minnesota Department of Administration or contact this court at (651) 296-6526. The WCD volumes can be typically found in the local law library.

The Minnesota Supreme Court Cases can also be researched on the Minnesota State Law Library website. Also, if you are looking for the current statutes and rules they are posted on the Minnesota Office of the Rivsor of Statutes website.
